Thank you for choosing Full Out. We are committed to protecting your privacy and ensuring the security of your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our software and services. We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on the Site, update the "Last updated" date and take any other steps required by applicable law.

Full Out, “we,” “us,” and “our”, is a platform that licenses software on a monthly basis to our Clients, “business” and “facility”, for business operation purposes. Clients can upload their Customer, “you” and “your”, Personal Information, public and non-public identifiable information, for business operation purposes; or you can register to a specific business and provide your own personal information. Certain personal information is required to access features and functionality within the platform. By using Full Out services, you are consenting to the practices described in this Privacy Notice.

Information Collected

We collect information that you provide to us, as well as information generated during your use of our software and services. A visit can include an in-person visit to a facility or visit via the app or website:

  • Account Registration: In order to gain access to the platform, you must register for an account with the business you choose to purchase goods and services from. The required personal information includes unique identifiers for members of your family that plan to engage with the business.
  • Information You Give Us: We receive and store any information you provide in relation to Full Out services. This is information you knowingly choose to disclose to the business. You can choose not to provide certain information, but then you might not be able to take advantage of many of our Full Out Services. This includes, but is not limited to:
  • Personal Information
  • Financial Information
  • Health Information
  • Content of In-App Messaging
  • Photos and Videos
  • Automatic Information:  We automatically collect and store certain types of information about your use of Full Out Services, including information about your interaction with products, content, and services. We also collect performance data, such as diagnostic information or device registration, that can be used by our development team.  
  • Payment Information: If you choose to make a purchase through the website or app to utilize goods or services provided by the business you registered your account with, you will be required to enter payment information required to complete a transaction securely. For example, some information you may include:
  • Credit Card Information
  • ACH Information
  • Addresses associated with the payment method
  • Other personal information as required by compliance
  • Communication:   You may find yourself needing help from time to time, and if you choose to correspond with our support team, we may retain the content of the correspondence including but not limited to phone calls, emails, or in-app messages. A few examples of how this helps our team; enable us to diagnose issues, implement solutions, or understand performance metrics.

How We Use the Information You Provide
The Full Out platform is designed to enable our clients to manage the day-to-day operations of their business. Businesses will use the information you provide for business activities and for customer service. We may use information from time to time as well to develop products and services or improve the platform's features and functionality. Some examples include:

  • Providing and improving our software and services.
  • Personalizing your experience.
  • Processing transactions and payments.
  • Communicating with you about updates, promotions, and support.
  • Analyzing usage patterns to enhance our offerings.

Information Sharing

We do not sell your personal information to third parties. However, we may share your information in the following circumstances:

  • With your consent.
  • To comply with legal obligations.
  • With service providers and partners who assist us in delivering our services.
  • In the circumstance that we are participating in the potential merger, acquisition, or sale.

Our software may contain links to third-party websites or services. We are not responsible for the privacy practices or content of these third parties. We encourage you to review the privacy policies of those websites.

Children

Full Out does not sell products or services for purchase by children. Our businesses sell children's health and fitness classes that are available for purchase by adults. If you are under 18, you may use Full Out Services only with the involvement of a parent or guardian. We do not knowingly collect personal information from children under the age of 13 without the consent of the child's parent or guardian.

All accounts registered to a business on the Full Out platform require an adult, commonly referred to as parent, to be the primary account holder. Parents can enter information about their child, commonly referred to as athlete, to be able to register them for classes, events, etc. Parents may choose to not share specific data with the business, but doing so may not allow them to access all the features or functionality of the platform. If a parent user on the app wishes, they can grant and revoke access to an account for their athlete.

We abide by the Children’s Online Privacy Protection Act (COPPA) and other relevant laws. If Full Out discovers personal data from a child gathered through the website, without parental consent, we will eliminate that data.

Length of Data Retention

Full Out retains your personal information for as long as the business needs it to perform their business operations. This includes for legal, reporting, or accounting purposes. Business may store your personal information in copies outside of the platform as the business deems necessary. If you would like more information on the data retention practices of the business you registered for, please contact the individual facility. We will continue to review the policies regarding how we process, collect, and store data to ensure we are compliant with the current requirements.

Cookies

We use cookies and similar technologies to enhance your experience, analyze usage patterns, and improve our services. You can manage your cookie preferences through your browser settings. We currently use limited cookies to help with authentication and not tracking.

Security

We implement reasonable security measures to protect your information from unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or electronic storage is entirely secure, and we cannot guarantee absolute security. We cannot promise that your use of our websites or mobile applications will be completely safe. We encourage you to use caution when using the Internet. Online access to your personal information is protected with a password you select. We strongly recommend that you do not share your password and that you use unique passwords for all of your online accounts.

When you place orders on our websites or through our mobile applications, all of your order information, including your credit card number and delivery address, is transmitted through the Internet using Secure Sockets Layer (SSL) technology. SSL technology causes your browser to encrypt your order information before transmitting it to our secure server. SSL technology, an industry standard for secure checkout, is designed to prevent someone other than operators of our websites from capturing and viewing your personal information. The servers are secured and guarded behind a bastion host using latest SSL standards from Amazon Web Services along with a virtual private network such that network access is protected under severe security groups and access controls, and access to the machine is severely restricted.

Our team continues to evaluate the best practices and requirements for security and makes upgrades when needed. We do not recommend sending in-app messages or emails containing confidential information such as personal information or banking information.

Individual Rights to Access Personal Data

You  have the right to know what personal information is stored by Full Out and to ensure that your personal data is accurate. You have access to your family’s personal information in the platform, but if you ever have a concern, please contact the business in which you are registered to. We will make a reasonable effort to share requested data with you, however, access to data may be declined if it risks the privacy of other users, does not align with our policies, breaks any laws or regulations, or is a bad business practice.

You have the right to not provide personal information, but you may not be able to use all features or functionality of the Full Out platform. If you want to withdraw consent of your personal information at any time, please contact the business in which you are registered with.

Disclaimer for Clients

It is your responsibility to stay informed about changes in laws, regulations, and industry standards that may impact your business and to update your businesses policies accordingly. The policies outlined in the Privacy Policy are intended as a statement for Full Out software, not as a protection for your own business. You have the option of replacing the Privacy Policy on pages within the platform. While we strive to offer a comprehensive and adaptable set of policies, it is crucial to acknowledge that these are not tailored to the specific needs or legal requirements of your business.

We strongly recommend seeking legal counsel to assess the suitability of the default policies and terms for your business, making any necessary adjustments, and regularly updating them to reflect changes in laws or business practices. Reliance on the default content without proper customization may result in inadequate legal protection for your business.
